This Privacy Policy is governed by:

  • Law No. 29733 — Personal Data Protection Law of Peru

  • Law No. 29571 — Code of Consumer Protection and Defense

3. PERSONAL DATA COLLECTED

Through the website and the services provided, the following personal data may be collected:

  • a) Identification data: names and surnames, DNI number, RUC, passport, or foreigner registration card (carné de extranjería).
  • b) Contact data: email address, physical address.
  • c) Data related to the contracted service: nature of the legal matter, documents provided, property or registry information necessary for the provision of the service.
  • d) Browsing data: IP address, browser type, pages visited, and duration of the visit (see Cookie Policy).
  • e) Complaints Book data: in case of filing a claim or complaint, in accordance with Law No. 29571.
  • f) Payment data: information necessary to process payments through the Mercado Pago payment gateway, such as the cardholder’s name, card details, or payment method. This data is processed directly by the payment provider and is not stored by the website.

No sensitive data (ethnic origin, health, political opinions, religious affiliation) is collected without express consent.

4. PURPOSE OF PROCESSING

The personal data collected is used exclusively to:

  • a) Provide the contracted legal services and manage the professional relationship with the client.
  • b) Respond to inquiries, requests, or claims submitted through the website or other means.
  • c) Comply with applicable legal and tax obligations (issuance of fee receipts, declarations to SUNAT).
  • d) Manage the Complaints Book in accordance with Law No. 29571.
  • e) Send communications related to the contracted service.
  • f) Improve the operation and content of the website.

The data will NOT be used to send third-party advertising or transferred to companies for commercial purposes.

5. LEGAL BASIS FOR PROCESSING

The processing of personal data is based on:

  • The consent of the data subject, granted upon completing forms on the website or contracting the services (Art. 13 of Law No. 29733).

  • The execution of the contractual relationship derived from the provision of legal services.

  • Compliance with applicable legal obligations, such as tax, administrative, and registry obligations.

  • The legitimate interest of the data controller in improving the quality of service, customer attention, and the operation of the website.

Data processing required for payment management is carried out through external payment service providers (such as the Mercado Pago payment gateway), who act as data processors and comply with applicable security standards, with such data being processed directly by these providers.

6. RETENTION PERIOD

Personal data will be kept for the time necessary to fulfill the purpose for which they were collected, and in any case:

  • During the duration of the professional relationship with the client.

  • For a minimum of five (5) years after the conclusion of the service, in compliance with tax obligations and professional record-keeping (Art. 87 of the Tax Code).

  • Complaints Book data will be kept for a minimum of two (2) years in accordance with Supreme Decree No. 011-2011-PCM.

7. RECIPIENTS AND DATA TRANSFER

Personal data will not be transferred to third parties, except in the following cases:

  • a) When necessary for the provision of the contracted legal service, including payment management through the Mercado Pago payment gateway, as well as the intervention of notaries, SUNARP, INDECOPI, the Judiciary, or other competent public bodies.
  • b) By legal obligation or requirement of a competent authority.
  • c) With the express consent of the data subject.
  • d) To technology service providers that enable the operation of the website and payment management, such as the Mercado Pago payment gateway, who act as personal data processors in accordance with current regulations.

In no case will data be sold or transferred to third parties for commercial or advertising purposes.

8. RIGHTS OF THE DATA SUBJECT

In accordance with Arts. 19 to 24 of Law No. 29733, the data subject has the right to:

  • ACCESS: Know which of their personal data is being processed.

  • RECTIFICATION: Request the correction of inaccurate or incomplete data.

  • CANCELLATION: Request the deletion of their data when it is no longer necessary.

  • OPPOSITION: Object to the processing of their data in certain circumstances.

To exercise any of these rights, the data subject must send a written request to the email: legales@leydyalvino.com, identifying themselves with their full name and document number. The response will be issued within a maximum period of twenty (20) business days.

9. DATA SECURITY

Technical and organizational measures are adopted to ensure the security of personal data and prevent its alteration, loss, unauthorized processing, or access, in accordance with Directorial Resolution No. 019-2013-JUS/DGPDP.

10. CONTROL AUTHORITY

The competent body for personal data protection in Peru is the National Authority for the Protection of Personal Data of the Ministry of Justice and Human Rights (MINJUSDH), located at Scipión Llona 350, Miraflores, Lima. Website: www.minjus.gob.pe.

11. MODIFICATIONS

This Privacy Policy may be updated to adapt to regulatory or service changes. Any substantial modification will be notified through the website, indicating the date of the last update.
